1. Agreement to Terms

By accessing or using the website of OzoneX AI (ozonexai.com) or engaging us for software development, design, AI engineering, or marketing services, you agree to comply with and be bound by these Terms & Conditions.

2. Scope of Services

OzoneX AI provides custom software engineering, mobile app development (iOS & Android), website design, Generative AI solutions, SEO, and performance growth services.

• Project Scope: The exact deliverables, timelines, and milestones will be detailed in the project proposal or Service Level Agreement (SLA) signed by both parties.
• 30-Day Free Post-Deployment Bug Fix Guarantee: We provide 30 calendar days of complimentary bug fixes for any functional defects within the agreed project spec starting from the production launch date.
• Free Production Deployment Support: Complimentary initial production setup on AWS, Vercel, GCP, or client servers including CI/CD pipelines and SSL certificates.
• Revisions: Unless otherwise specified, each milestone allows for a reasonable number of revisions within the project scope. Work requested outside the agreed scope will be subject to additional billing.

3. Payments & Billing

Clients agree to adhere to the payment schedule outlined in the project proposal/invoice:

• An advance/kickoff payment is required before any development work begins.
• Remaining payments will be billed upon completion of specified project milestones or stages.
• Strict No-Refund Policy: All milestone payments and retainers are non-refundable once engineering sprints, technical architecture, or development work has commenced.
• Invoices must be paid within 7 business days of receipt. Delayed payments may result in suspension of work and project delay.

4. Intellectual Property

We care deeply about your ownership rights:

• Upon full and final payment of all outstanding invoices, 100% complete ownership, source code rights, repository access, and design assets of the custom application developed will be transferred to the Client.
• OzoneX AI retains the right to showcase screenshots and non-sensitive parts of the developed interface in our public portfolio for promotional purposes, unless a strict White-Label or custom NDA is signed beforehand.

5. Client Responsibilities

The success of a project depends on mutual collaboration. The Client agrees to provide timely feedback, raw materials (such as logo, brand guidelines, content text, images), and any necessary access credentials (hosting, domains, API keys) required for project completion. We are not liable for project delays caused by a client's failure to provide assets or feedback in a timely manner.

6. Termination of Services

Either party may terminate the engagement by providing 14 days written notice if the other party breaches any material term of these Terms and fails to cure such breach within the notice period. In the event of termination, the client will be billed for all hours or milestones completed up to the date of termination.

7. Limitation of Liability

In no event shall OzoneX AI, its founder, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to the use of our services or software, even if advised of the possibility of such damages.

8. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Muzaffarpur, Bihar, India.
